TERMS OF PURCHASE

GENERAL PROVISIONS

These terms (hereinafter referred to as Terms) constitute an agreement between Annika retail, MB, company code 306978556, registered office at Žvaigždžių g. 4, Radikių k., LT-54347 Kaunas District (hereinafter referred to as Seller) and you, under which the Seller will provide you with the opportunity to purchase products (hereinafter referred to as Products) and gift vouchers (hereinafter referred to as Gift Vouchers) offered on the website http://annika.lt/ (hereinafter referred to as Online Store).

You are entitled to purchase from the Online Store only if you are legally capable of entering into a binding contract with the Seller and if you comply with these Terms and applicable laws. If you are under 18 years of age, you may only make purchases from the Online Store with the consent of your parents or other legal representatives. By placing an order, you confirm that you are 18 years or older, or that you have the consent of your parents or other legal representatives.

PURCHASE FROM THE ONLINE STORE

When you visit the Online Store and select Products, a shopping cart is created based on your selection.

Once the cart is created, you must enter the information necessary for the delivery of the selected Products. Ensure that the information provided is accurate and that the ordered Products meet your preferences. You have the option to correct any errors, if present, before confirming the order. The information you provide is processed in accordance with the Privacy Policy.

By placing an order in the Online Store, you agree to pay the price indicated in the order for the Products. The price indicated in the Online Store and in the order includes all taxes, but does not include the delivery fee, which you will need to pay separately (unless otherwise specified in the Online Store). Prices in the Online Store and in the order are stated in Euros.

You can pay for the Products using electronic banking, credit card, or bank transfer.

Payments can be made using electronic banking services of Swedbank, SEB, Luminor, Citadele, Šiaulių, Medicinos, Revolut banks, credit unions, Maxima cash registers, Perlo terminals, and others. Payments are available in Euro currency. Payments are processed through the Paysera payment platform.

Payment must be made immediately after placing the order.

Once you confirm the order, the Seller receives all the information about it. The order is considered placed from the moment it is received by the Seller. At this point, a contract is considered to be formed between you and the Seller. However, the Seller is obliged to fulfill the contract only once the Seller receives confirmation of payment from the payment service provider.

After placing the order, an email will be sent to your specified email address, indicating the ordered Products and the information you provided.

Upon receiving notification of payment for the ordered Products, the Seller is obligated to fulfill your order. If the company voluntarily cancels a user’s order, stating that the warehouse does not have the requested Products (or for other reasons), a refund will be made within 14 days, but without undue delay.

This section also applies to the purchase of Gift Vouchers.

CHARACTERISTICS AND QUALITY OF THE PRODUCTS

The characteristics of the Products are specified in the Online Store next to each Product description. The Seller aims to ensure that the Products meet the requirements established by legal acts and are suitable for their intended use.

By placing an order, you confirm that you are aware and understand that the Products described in the Online Store may not match the actual size, shapes, and colors of the Products due to the characteristics or settings of your monitor or other devices. Such discrepancies will not be considered as defects in the Products, except where the discrepancies are caused by the Seller or third parties related to the Seller.

The Seller undertakes to deliver Products that match the information provided in the Product description on the Online Store. The Seller also undertakes to provide you with the assortment and quantity of Products specified in the order but does not take responsibility in cases where the assortment or quantity of the delivered Products is incorrect due to inaccurate information provided in the order.

PRODUCT DELIVERY

When ordering Products, you must provide a delivery address and contact phone number (if the Products are delivered within Lithuania, the number must be registered in Lithuania). Delivery is available in the following ways: delivery to LP EXPRESS parcel terminals (self-service kiosks) or through LP EXPRESS couriers, or to UAB "Omniva" parcel terminals (self-service kiosks) or through UAB "Omniva" couriers. The nearest Omniva parcel terminal is selected automatically based on the postal code of your address (you do not need to choose the terminal yourself).

  • Delivery costs in Lithuania via parcel terminal - from 2 EUR.
  • Delivery costs in Lithuania via courier - from 5 EUR.
  • Delivery costs abroad - from 6 EUR.
  • Free delivery - from 40 EUR*

Orders are dispatched within 1-2 working days. From the dispatch date, orders are usually delivered:

  • In Lithuania within 1-3 working days.
  • In Europe within 5-9 working days.
  • US and other countries within 7-14 business days.

Please note that the specified delivery or pickup times are approximate. While we always strive to process orders as quickly as possible, preparation may take longer due to high order volumes or the availability of delivery service providers. The Seller will always provide updates on delivery status; follow this information. Once the shipment is dispatched, you can track it using the shipment number in the delivery service provider's system.

If upon receiving the Products you notice that an ordered Product is missing, notify the Seller immediately.

Products are delivered packaged according to their nature to ensure they are suitable for their intended use.

EXCHANGE OR REFUND OF GOODS

Cancellation within 30 days (consumers only)

If you purchase from the Online Store as a consumer (i.e., an individual acting for purposes not related to business, trade, craft, or profession (for personal use)), you have the right to return the Products or Gift Vouchers (as long as they are unused) within 30 (thirty) calendar days from the date you received the Product or Gift Voucher. You can do this without providing a reason (i.e., exercising your right to withdraw from a distance contract provided by Lithuanian and European Union laws).

If you withdraw from the contract, the Product must be unused, with labeling tags and in its original packaging, undamaged and not losing its commercial appearance. We will consider this requirement met if you have only performed actions necessary to assess the Product and which you would normally perform if inspecting the Product in a physical store (e.g., trying on or examining the Product).

To exercise this right, you must notify the Seller no later than 30 (thirty) calendar days from the receipt of the Product or Gift Voucher by filling out the online return notification form and informing the Seller by email at info@annika.lt.

If you decide to withdraw from the contract, you must immediately and in any case, no later than 30 (thirty) calendar days from the date you notified the Seller by email, return the Products to the Seller at Biliūno g. 10-11, 10150 Vilnius, or for Gift Vouchers, permanently delete the Gift Voucher and its details. The deadline will be met if you send the Products before the 30 (thirty) day period expires. You must cover the costs of returning the Products to the Seller.

If you withdraw from the contract, the Seller undertakes to refund all amounts paid for the Product and its delivery to your specified bank account no later than 14 (fourteen) calendar days from the day you notified the Seller by email, but not earlier than the Seller receives the returned Product (unless the Seller decides at its discretion not to wait for the returned Product).

Wholesalers and other buyers who purchase from the Online Store not for personal use do not have the right to withdraw from the contract unless explicitly agreed otherwise in writing with the Seller.

Defective Products

Products are subject to the statutory guarantee under Lithuanian law, which means the Seller is responsible for any non-compliance with quality requirements at the time of delivery and for defects discovered no later than two years from the delivery of the Product.

If a Product purchased from the Online Store is of unsatisfactory quality, you have the right to request the Seller to remove the defects free of charge or replace the defective Product with a satisfactory one, and in statutory cases request a corresponding price reduction or return the Product.

If you believe that a Product purchased from the Online Store is of unsatisfactory quality and have identified defects, you must notify the Seller by email within two months from the date of discovering the non-compliance, indicating your preferred solution. When reporting a defective Product, provide a detailed description of where and when the defect occurred, include photos of the Product and the defect, and other relevant information to help identify the defect.

The rights of the buyer related to defective Products are exercised according to Articles 6.364(1)-6.364(3) of the Civil Code of the Republic of Lithuania.

GIFT VOUCHERS

Gift Vouchers are valid for the period specified on them. The recipient of a Gift Voucher must use it in the Online Store, i.e., redeem the Gift Voucher for Products offered in the Online Store, within the period specified on the Gift Voucher. If the Gift Voucher is not used within the specified period, the period will not be extended, and the Gift Voucher will become invalid, and the money

INTELLECTUAL PROPERTY

Trademarks and Other Marks: Trademarks and other identifiers used for Products and Gift Vouchers belong to the Seller and/or other parties and are protected by law. All intellectual property rights in Products and Gift Vouchers, including their individual parts, also belong to the Seller and/or other parties.

E-Shop Content: Trademarks and logos, domain names, the e-shop itself, and the website on which it is hosted, including all individual elements such as texts, photographs, drawings, and all other material on the e-shop and website, as well as the presentation, appearance, and design of any page of the e-shop or website, are exclusively owned by the Seller and/or other parties. You agree not to copy, modify, or otherwise use these intellectual property objects without separate written consent from the rights holder.

LIABILITY

Seller's Liability: The Seller’s liability for the quality and delivery of Products is governed by applicable laws.

Information and Address: You must provide the Seller with all accurate and complete requested information. You are responsible for providing the correct delivery address for Products.

CHANGES AND TERMINATION

Changes to Terms: The Seller may periodically change these Terms. The latest (current) version of the Terms will always be visible and accessible on the e-shop. Before confirming an order, you must review the version of the Terms in effect at that time. Each order will be subject to the Terms in effect at the time of order confirmation.

Termination of E-Shop: The Seller reserves the right to cease (terminate) the e-shop’s operations at any time. Such termination will not affect the purchase and sale contracts in effect at that time.

OTHER TERMS

Governing Law: These Terms and any purchase and sale agreements are governed by and should be interpreted in accordance with the laws of the Republic of Lithuania.

Dispute Resolution: Any disputes, disagreements, or claims arising from these Terms or any purchase and sale agreement, including issues of violation, termination, or validity, will be resolved by the courts of the Republic of Lithuania according to Lithuanian law. The competent authority for resolving consumer disputes arising from these Terms is the State Consumer Rights Protection Authority (address: Vilniaus g. 25, LT-01402 Vilnius, phone (8 5) 262 6751, email tarnyba@vvtat.lt; website: http://www.vvtat.lt), or http://ec.europa.eu/odr/.

Notices: All notices or other communications related to purchasing from the e-shop and these Terms will be sent via email (to the Seller’s email address provided at the beginning of these Terms, and to you at the email address provided at the time of the order).

Invalidity: If any provision of these Terms is or becomes fully or partially invalid, it will not affect the validity of the remaining provisions.

 

PRIVACY POLICY

Privacy Protection: We protect visitors' privacy in the online space. Personally identifiable information about a visitor will not be disclosed to any third party without the visitor's consent or as required by relevant legal or governmental authorities.

Payment Processing: Payments in the e-shop are processed using the Paysera payment platform, managed by Paysera LT, UAB (Pilaitės pr. 16, LT-04352 Vilnius, company code 300060819). Therefore, your personal information necessary for payment execution and confirmation will be transferred to Paysera LT, UAB.

Payment and Refunds: Payments are made through the Paysera payment system, using debit or credit cards or bank transfers. We commit to refunding all amounts paid for the product and its delivery to your specified bank account within 14 calendar days from the day we are notified of the return by email, but not earlier than when we receive the returned product (unless we decide at our discretion not to wait for the returned product).

Remarketing Data Collection: This site uses Google/Facebook Remarketing and cookies to collect basic information about users. Our ads are displayed on various pages using Google/Facebook and third-party services.

Personal Data Collection: During each purchase, we collect visitor input such as name, surname, email address, phone number, delivery address, and other details. This information is used to process orders and provide better services to users. Personal data is used only in relation to this online store and associated products to provide and access information to visitors.

Use of Personal Data: Users' personal data will be used only in connection with products and processes related to the service. Visitor data is recorded and disclosed only in cases of violation and only to relevant state officials or institutions. Other information about the user is provided only to the user themselves with their consent or as required by relevant state institutions, by court order or a search warrant issued by a prosecutor.

Other Communications: Other notifications and offers may be provided to users with their consent and not exceeding their privacy, as specified by Lithuanian law.

Privacy Policy Changes: This online store may change its privacy policy at any time, with advance notice on its website. Users are advised to regularly review the privacy policy.

Anti-Spam Policy

Spam Guarantee: We guarantee our clients that their email addresses will not be used for sending spam. Additionally, users who provide their data will not receive emails:

  • With invalid or forged email headers;
  • With invalid or non-existent domain names;
  • With misleading transmission location or path information;
  • With other misleading addressing methods;
  • Containing misleading or false information in the subject line;
  • Providing misleading or false content in the email;
  • Violating service terms and conditions.
